A useful request identifies the person, approximate admission date, and any booking number, then asks for the release date and time, release type, authority, and destination. If a photo is needed, ask separately for the adult routine initial-intake booking photograph in its existing electronic form. Invite redaction of exempt content and request a cost estimate.
Virginia FOIA generally calls for one of the statutory responses within five working days. The office may produce the record, cite a withholding rule, provide part, state that it cannot locate the record, or invoke allowed extra time. The court record adds legal context but may not state the door-out time. Montgomery General District Court handles misdemeanors and preliminary felony matters, while Circuit Court handles felony trials, sentencing, and appeals. A dismissal on one charge may coexist with another hold. Likewise, sentence completion can be followed by probation or transfer. Build a short chronology from booking, court action, jail departure, receiving custody, and later supervision instead of forcing one date to answer every question.
Montgomery Jail Electronic Monitoring Release
Montgomery County documents Home Electronic Monitoring for screened, sentenced nonviolent offenders under Section 53.1-131.2. Screening appointments are listed Monday through Friday from 8 a.m. to 4 p.m., after sentence. The county also lists Monday reporting from 11 a.m. to 1 p.m. and extension 4417. A weekly monitoring fee is mentioned, but the reviewed page does not publish the amount.
Home electronic monitoring moves an approved person out of the jail building while the sentence and custody controls continue. It is not the same as full discharge. The public release entry, court order, or program record should be read for the exact legal status. If a person appears outside the building under monitoring, that fact cannot be used to infer that the sentence ended or that supervision was discharged.
Program screening also does not promise a set departure time. Eligibility, approval, court terms, residence checks, equipment, and other holds may affect the result. Contact the Corrections Division for the current process and for the recorded status of a specific placement.
ICE Transfers from Montgomery Jail
ICE describes a detainer as a request that a local jail give notice and maintain custody for up to 48 hours beyond the point when the person would otherwise be released, allowing ICE to assume custody. A Montgomery County Jail entry described as release to ICE therefore does not mean release into the community. Ask the jail for the receiving authority and transfer time.
